On 1 January 2020, the Act on termination of some execution proceedings has entered into force. As a result, the so-called “old executions” were terminated as at 1 January 2020, whereby according to the Act, an old execution means an execution commenced prior to 1 April 2017. On the day on which the Act has entered into force, the executions, which as at 1 January 2020 had lasted for more than five years (this is the so-called decisive period) and in which in the last 18 months proceeds in the minimum amount of € 15 had not been achieved, shall be terminated. The Act also sets out exemptions from the termination of old executions, for example in the event of maintenance claims, the recovery of performance awarded by a decision of an institution, body, office and agency of the European Union or the recovery of performance awarded by a decision of an administrative body in the matter of violation of competition rules, and also provides for the extension of the decisive period, provided that on the day when an old execution is to be terminated, a court is deciding, for example, on objections to the old execution, on the exclusion of an item from the old execution, on the approval of the fall of the hammer or on the approval of the distribution of proceeds.
